Interpretation

This article establishes the duty to protect cultural and natural heritage. Together with Articles 79, 80, and 95(8), it forms Colombia's 'ecological constitution.' The Constitutional Court has recognized rights of natural entities like the Atrato River (T-622/2016), following trends in Latin American environmental constitutionalism and the Ecuadorian Constitution's 'rights of nature' (Pachamama). This represents a shift from anthropocentric to ecocentric legal frameworks.
