Article 12

Official text

No one shall be subjected to forced disappearance, torture, or cruel, inhuman, or degrading treatment or punishment.

Legal commentary

Interpretation

This article prohibits forced disappearance, torture, and cruel treatment. The specific mention of forced disappearance is particularly significant given Colombia's armed conflict history. This provision aligns with the Inter-American Convention on Forced Disappearance of Persons (1994) and the UN Convention against Torture. Unlike the US Eighth Amendment's focus on 'cruel and unusual punishment,' this article has broader scope covering all cruel treatment.
